These Terms of Service (“Terms”) are a legal agreement between you and 33touch (“33touch,” “we,” “us,” or “our”) governing your access to and use of the 33touch application and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service
33touch is an AI transaction-coordination tool for real-estate professionals. It can connect to your email inbox to detect transaction-related messages, extract details such as parties and key dates, organize documents, and surface upcoming deadlines. The Service is a productivity tool; it is not a party to your transactions and does not provide legal, financial, tax, or brokerage advice.
2. Eligibility
You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a brokerage or other organization, you represent that you are authorized to bind that organization to these Terms.
3. Accounts
You are responsible for your account credentials and for activity that occurs under your account. Keep your login secure and notify us promptly of any unauthorized use.
4. Gmail authorization
If you connect Gmail, you authorize 33touch to (a) read your mailbox in order to identify and process real-estate transaction email, and (b) send email from your address on your behalf, in each case as described in our Privacy Policy. We will send a message from your account only after you have reviewed that specific message and explicitly approved it; you are responsible for the content of messages you approve, and they are treated as sent by you. You represent that you have the right to grant this access for the mailbox you connect. You may disconnect at any time within the Service or revoke access at myaccount.google.com/permissions.
5. Your content
You retain all rights to the contracts, documents, and other content you provide or that we process on your behalf (“Your Content”). You grant us a limited, non-exclusive license to host, process, and display Your Content solely to provide and improve the Service for you. We do not claim ownership of Your Content and do not sell it.
6. AI output & your responsibility
Important — verify before you rely
The Service uses automated and AI-based processing to read documents and extract information such as dates, names, and amounts. This output may be incomplete or incorrect. 33touch does not guarantee the accuracy of any extracted data, deadline, reminder, or document classification.
You remain solely responsible for verifying all transaction details against the source documents and for meeting every deadline and obligation in your transactions. Do not rely on the Service as your only system of record, and do not treat its output as legal, financial, or professional advice.
7. Acceptable use
You agree not to: use the Service unlawfully or to violate others’ rights; connect a mailbox you are not authorized to access; attempt to disrupt, reverse engineer, or gain unauthorized access to the Service; or use the Service to build a competing product. We may suspend access for conduct that violates these Terms or threatens the security of the Service.
8. Third-party services
The Service relies on third parties, including Google (authentication and Gmail), Anthropic (AI processing), and DigitalOcean (hosting). Your use of those integrations may also be subject to the third party’s terms. We are not responsible for third-party services.
9. Fees
Some features may be offered free of charge during a beta or trial period. If we introduce paid plans, we will present pricing and obtain your agreement before charging you. We may change pricing prospectively with notice.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EXTRACTED DATA WILL BE ACCURATE OR COMPLETE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 33TOUCH AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR A MISSED DEADLINE OR TRANSACTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR USD $100.
12. Indemnification
You agree to indemnify and hold harmless 33touch from claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination (including content ownership, disclaimers, limitation of liability, and indemnification) will survive.
14. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state and federal courts located in Delaware, unless applicable law requires otherwise.
15. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and revise the “Last updated” date, and we will provide additional notice for material changes. Continued use after changes take effect constitutes acceptance.
